§ 1. Definitions

  1. Regulations - these terms and conditions of the MAGBOSS Auto online store.

  2. Seller - MAGBOSS AUTO PARTS & ACCESSORIES Sp. z o.o. with its registered office in Warsaw. 

  3. Online store - the website available at www.magbossauto.pl, through which the Customer may place orders.

  4. Customer - a natural person, legal person or organizational unit without legal personality that uses the Store or places an order.

  5. Consumer - a natural person making a purchase not directly related to his or her business or professional activity.

  6. Entrepreneur with consumer rights - a natural person entering into an agreement directly related to their business activity, if the content of the agreement indicates that it does not have a professional character for that person.

  7. Product - an item offered in the Store, in particular car parts, automotive accessories, original parts, OEM parts and replacements.

  8. Order - the Client's declaration aimed at concluding a sales agreement for the Product.

  9. Customer Account - the Customer's individual panel in the Store, available after registration and login.

  10. Business days - days from Monday to Friday, excluding public holidays.

  11. Special order - an order concerning a Product sourced, prepared or selected individually for the Customer, in particular according to the VIN number, vehicle specifications or other data provided by the Customer.


§ 2. General provisions

  1. The Terms and Conditions define the rules for using the online Store, placing orders, concluding sales agreements, payments, delivery, complaints and withdrawal from the agreement.

  2. The condition for using the Store is familiarizing yourself with the Terms and Conditions and accepting them when placing an order.

  3. The Store sells car parts and accessories, in particular for Chinese car brands such as MG, BAIC, OMODA, JAECOO, BYD and other brands available in the offer.

  4. The Store's offer may include genuine parts, OEM parts and verified replacements.

  5. The information on the Store's website, including descriptions, photos, prices and product availability, does not constitute an offer within the meaning of the Civil Code, but an invitation to conclude a contract.

  6. To use the Store you need a device with Internet access, an up-to-date web browser, an active email account and cookies enabled to the extent necessary for the Store to function properly.

  7. The Customer is obliged to use the Store in a manner consistent with the law, good practices and the provisions of the Terms and Conditions.

  8. It is prohibited for the Customer to submit content of an unlawful nature.

  9. All brand names, vehicle models, manufacturers and part designations used in the Store are for informational purposes and serve to identify products and their applications.


§ 3. Customer Account and Purchases Without Registration

  1. A Customer may create a Customer Account in the Store.

  2. Account registration is voluntary and free of charge.

  3. Creating an Account enables, among other things, access to order history and easier placement of subsequent orders.

  4. A Customer may also make a purchase without registration by providing the data necessary to fulfill the order.

  5. The Customer is obliged to provide true and up-to-date information.

  6. The Customer should protect the account access data from unauthorized access.

  7. The Customer may at any time request the Seller to delete the Account by contacting the following e-mail address: kontakt@magbossauto.pl.

  8. Complaints concerning the operation of the Account or services provided electronically can be submitted by e-mail to: kontakt@magbossauto.pl. The Seller will consider the complaint within 14 days from the date of its receipt.


§ 4. Placing orders

  1. Orders can be placed via the online Store www.magbossauto.pl.

  2. To place an order, the Customer selects the Product, adds it to the cart, indicates the delivery and payment method, and provides the data necessary to fulfill the order.

  3. Before placing the order, the Customer receives information about the total price of the Product, delivery costs, and the chosen payment method.

  4. Placing an order constitutes an obligation to pay.

  5. The sales agreement is concluded at the moment the Seller confirms acceptance of the order.

  6. The Seller may contact the Customer to confirm details, check product availability, match parts to the vehicle, or determine order specifics.

  7. For parts that need to be fitted to a specific vehicle, the Customer may be asked to provide additional information, such as make, model, year of manufacture, engine version, VIN number, or a photo of the existing part.

  8. If it is not possible to fulfill the order, the Seller will promptly inform the Customer and will refund any payments received, if they were made.


§ 5. Special orders and parts sourced on request

  1. Some Products may be sourced to fulfill an individual Customer's order.

  2. A special order may relate in particular to hard-to-find parts, parts ordered from a supplier, parts selected by VIN number, vehicle specification, or other data provided by the Customer.

  3. For special orders, the Seller may require payment of a partial prepayment or deposit before starting order fulfillment.

  4. The amount of the prepayment and the expected order fulfillment date are agreed individually with the Customer before confirming the order.

  5. The Customer will be informed whether the given Product is available immediately or needs to be sourced.

  6. For Goods procured on an individual order, the fulfillment time may be longer than the standard shipping period.

  7. The right to withdraw from the contract may not apply to non-prefabricated Goods, Goods prepared or procured according to the Customer's specifications, or Goods intended to satisfy the Customer's individualized needs, in accordance with applicable law.

  8. Information about any lack of the right to withdraw from the contract for a given Special Order should be provided to the Customer before the order confirmation.


§ 6. Prices and payments

  1. The prices of Goods listed in the Store are gross prices and include VAT, unless stated otherwise for a given Good.

  2. Prices do not include delivery costs, unless explicitly stated otherwise.

  3. Available payment methods:
  4. - traditional bank transfer to the Seller's bank account,
  5. - electronic payment via the imoje system,
  6. - cash payment for in-person pickup,
  7. - cash on delivery payment for courier delivery, if that option is available for the given order.

  9. The customer should include the order number in the transfer title.

  10. If payment is not received within the agreed time, the Seller may cancel the order after 3 business days.

  11. A receipt or VAT invoice may be issued for the order, according to the information provided by the Customer when placing the order.

  12. For electronic payments processed by the imoje system, payment is carried out in accordance with the payment operator's terms and conditions.

  13. For Special Orders the Seller may require prepayment or a deposit, which the Customer will be informed of before the order is confirmed.


§ 7. Delivery and local pickup

  1. The Shop delivers within Poland and abroad.

  2. Available delivery methods:
  3. - courier parcel,
  4. - parcel locker (paczkomat),
  5. - local pickup.

  6. Deliveries may be carried out, among others, via courier companies: InPost, DPD, DHL, UPS and other carriers available in the Shop.

  7. Goods available in stock are usually shipped within 24 hours of order confirmation or payment being posted, excluding public holidays.

  8. For international deliveries, shipment may also occur within 24 hours; however, delivery time depends on the destination country, chosen shipping method, and carrier.

  9. The delivery cost is shown to the Customer before placing the order.

  10. For custom orders, oversized shipments, or international deliveries, the delivery cost may be determined individually.

  11. In-person pickup is possible at the warehouse address: ul. Tadeusza Kościuszki 8, 96-100 Skierniewice, after prior confirmation of the availability of the Goods.

  12. When receiving the shipment, the Customer should check the condition of the packaging. If visible damage is present, it is recommended to prepare a damage report with the carrier and contact the Seller.

  13. If a shipment is found to be damaged, incomplete, or not in accordance with the order, the Customer should promptly notify the Seller.


§ 8. Withdrawal from the contract and returns

  1. A Client who is a Consumer and an Entrepreneur with consumer rights has the right to withdraw from a distance contract within 14 days without giving a reason.

  2. The 14-day period is counted from the day the Product is taken into the possession of the Client or a third party indicated by them other than the carrier.

  3. To exercise the right of withdrawal from the contract, the Client should inform the Seller of their decision by means of a clear statement, e.g. by e-mail to: kontakt@magbossauto.pl.

  4. The Product should be returned to the address: MAGBOSS AUTO PARTS & ACCESSORIES Sp. z o.o., ul. Tadeusza Kościuszki 8, 96-100 Skierniewice.

  5. In the event of withdrawal from the contract, the Client bears the direct costs of returning the Product to the Seller, unless the Seller has expressly agreed to bear them or the law provides otherwise.

  6. The Client is obliged to properly secure the returned Product for the duration of transport.

  7. The returned Product should not show signs of use beyond what is necessary to establish its nature, characteristics and functioning.

  8. In particular, the returned part should not be installed, used, soiled, damaged or incomplete.

  9. The Customer is responsible for any reduction in the value of the Goods resulting from using them in a way that goes beyond what is necessary to establish their nature, characteristics and functioning, in particular for signs of installation, use, soiling, damage or incompleteness of the Goods.

  10. The Seller will refund the Customer the payments received, including the cost of the cheapest standard delivery offered in the Store, no later than 14 days from the date of receipt of the statement of withdrawal from the contract.

  11. The Seller may withhold the refund until the Goods are received back or the Customer provides proof of their dispatch.

  12. The refund will be made using the same payment method the Customer used, unless the Customer agrees to a different method of refund.

  13. The right of withdrawal from the contract does not apply in cases specified in the applicable law, in particular when the subject of the performance is a non-prefabricated Good, prepared according to the Customer's specification or intended to satisfy their individualized needs.

  14. To expedite the returns process, the Customer may include proof of purchase or an order number with the shipment.


§ 9. Complaints

  1. The Seller undertakes to deliver Goods that conform to the contract.

  2. The Customer has the right to file a complaint if the Product does not conform to the contract, is defective, damaged, or does not match the specifications agreed upon at the time of purchase.

  3. Complaints can be submitted:

  5. - by phone for initial contact: 793 222 000,
  6. - by returning the Product to the warehouse and claims address: ul. Tadeusza Kościuszki 8, 96-100 Skierniewice.

  7. The complaint submission should include:
  8. - the Customer's first and last name or company name,
  9. - order number,
  10. - description of nonconformity, defect, or damage,
  11. - date the problem was discovered,
  12. - Customer's request,
  13. - photos documenting the problem, if they may help with processing the complaint.

  14. The Seller will respond to the complaint within 14 days of its receipt.

  15. In the case of a justified complaint from a Consumer or an Entrepreneur with consumer rights, the Seller bears the costs associated with bringing the Goods into conformity with the contract, including reasonable costs of return shipping for the complaint.

  16. If it is necessary to return the Goods, the Customer should properly secure the parcel for transport.

  17. Complaints regarding damage sustained during transport should be reported as soon as possible after receiving the parcel. If packaging damage is visible, it is recommended to prepare a damage report with the carrier.

  18. This Regulations does not limit the Customer's rights arising from generally applicable laws.


§ 10. Warranty

  1. Some Products may be covered by a warranty from the manufacturer, importer, distributor or Seller.

  2. Information about the warranty, if provided, may be included in the Product description, the warranty document, or documents attached to the Product.

  3. The warranty does not exclude, limit or suspend the Customer's rights arising from provisions regarding non-conformity of the Product with the contract.

  4. The terms of the warranty are specified in the warranty document or information provided by the guarantor.


§ 11. Personal Data

  1. The data controller of Customers' personal data is MAGBOSS AUTO PARTS & ACCESSORIES Sp. z o.o., headquartered in Warsaw.
  2. Customers' personal data are processed for the purpose of:
  3. - fulfilling orders,
  4. - handling payments,
  5. - delivering Goods,
  6. - handling complaints and returns,
  7. - managing the Customer Account,
  8. -  issuing accounting documents,
  9. - contacting the Customer,
  10. - the fulfillment of the Seller's legal obligations.

  11. Providing personal data is voluntary, but necessary to place and process an order.

  12. Personal data may be disclosed to entities cooperating with the Seller to the extent necessary to process the order, in particular payment operators, courier companies, entities providing IT, accounting, legal services, and entities entitled to obtain data under legal provisions.

  13. The Customer has the right to access their data, rectify it, delete it, restrict processing, transfer data, object, and file a complaint with the President of the Personal Data Protection Office.

  14. The detailed rules for processing personal data are specified in the Privacy Policy below.


§ 12. Out-of-court dispute resolution

  1. A Customer who is a Consumer may use out-of-court methods for handling complaints and pursuing claims.

  2. Information about out-of-court methods for resolving consumer disputes is available on the website of the Office of Competition and Consumer Protection.

  3. The customer may also seek assistance from the municipal or district consumer ombudsman.

  4. Using out-of-court dispute resolution methods is voluntary.


§ 13. Final provisions

  1. The Seller reserves the right to amend the Terms and Conditions for important reasons, in particular in the event of changes to legal regulations, payment methods, delivery methods, or Shop functionality.

  2. Orders placed before the amendment to the Terms and Conditions are governed by the Terms and Conditions in force at the time the order was placed.

  3. Matters not regulated by the Terms and Conditions shall be governed by the provisions of Polish law.

  4. Any disputes with Consumers shall be resolved in accordance with the applicable legal provisions.
  5. For Customers who are neither Consumers nor Entrepreneurs with consumer rights, the court competent to resolve disputes shall be the court competent for the Seller's registered office.

  6. The Regulations are available free of charge on the Store's website in a way that allows them to be downloaded, saved and printed.

  7. The Regulations are effective as of: 01.06.2026.


Privacy Policy

§ 1. General information

  1. This Privacy Policy defines the rules for processing the personal data of Customers and users of the online store available at www.magbossauto.pl.

  2. The data controller is MAGBOSS AUTO PARTS & ACCESSORIES Sp. z o.o., headquartered in Warsaw, Al. Jana Pawła II 27, 00-867 Warsaw, KRS: 0000928066, NIP: 525-288-14-97, REGON: 520247689.

  3. Contact with the Controller is possible:

  5. - by phone: 793 222 000.

  6. The Administrator takes due care to protect Customers' personal data, in particular against access by unauthorized persons, loss, destruction, unauthorized alteration or unlawful processing.


§ 2. Scope of processed data

  1. The Administrator may process personal data provided by the Customer when:
  2. - placing an order,
  3. - creating a Customer Account,
  4. - using the contact form,
  5. - contacting by e-mail or phone,
  6. - filing complaints, returns or withdrawal from the contract.

  7. Processed data may include in particular:
  8. - first and last name,
  9. - company name,
  10. - VAT ID (NIP),
  11. - delivery address,
  12. - billing address,
  13. - e-mail address,
  14. - phone number,
  15. - order details,
  16. - information required to issue an invoice,
  17. - bank account number in case of payment refund,
  18. - content of correspondence conducted with the Store.

  19. When selecting parts for a vehicle, the Administrator may also process data provided by the Customer, such as make, model, year of manufacture, vehicle version, VIN number or a photo of the part, if they are necessary for proper order handling.


§ 3. Purposes and legal bases for data processing

  1. Personal data is processed for the purpose of:
  2. - order fulfillment and conclusion of the sales agreement,
  3. - handling payments,
  4. - delivery of the Goods,
  5. - handling returns, complaints, and contract cancellations,
  6. - managing the Customer Account,
  7. - issuing invoices and accounting documents,
  8. - contacting the Customer,
  9. - responding to inquiries submitted via the contact form,
  10. - pursuing or defending against potential claims,
  11. - fulfilling legal obligations incumbent on the Administrator.

  12. The legal basis for data processing includes, in particular:
  13. - the necessity of processing to perform a contract or to take actions prior to entering into a contract,
  14. - a legal obligation incumbent on the Controller,
  15. - the Controller's legitimate interest,
  16. - the consent of the data subject, if required.


§ 4. Data recipients

  1. Personal data may be transferred to entities cooperating with the Controller only to the extent necessary for the provision of services.

  2. Recipients of data may include, in particular:
  3. - courier companies and logistics operators, including InPost, DPD, DHL, UPS and other carriers,
  4. - imoje payment operator,
  5. - banks and entities processing payments,
  6. - accounting office,
  7. - entities providing IT, hosting, and technical services,
  8. - entities operating the online store,
  9. - providers of analytical or marketing tools, if they are used and the Customer has given appropriate consent,
  10. - law firms or advisors, if needed to pursue or defend claims,
  11. - public authorities entitled to obtain data under legal provisions.

  12. Personal data is not sold to third parties.


§ 5. Data retention period

  1. Data related to order fulfillment is retained for the period necessary to perform the contract, and thereafter for the period required by law or until any claims become time-barred.

  2. Data contained in accounting documents are retained for the period required by tax and accounting regulations.

  3. Data processed on the basis of consent are retained until the consent is withdrawn, unless further retention is required by law.

  4. Data processed for the purpose of handling correspondence are retained for the time needed to provide a response and to safeguard any potential claims.

  5. Data related to the Customer Account are processed for the duration of the Account, and after its deletion for the period required by law or necessary to secure claims.


§ 6. Rights of the data subject

  1. The customer has the right to:
  2. - access their personal data,
  3. - rectify data,
  4. - erase data,
  5. - restrict processing,
  6. - data portability,
  7. - object to processing,
  8. - withdraw consent at any time if the data are processed on the basis of consent.

  9. Revoking consent does not affect the lawfulness of processing carried out before its revocation.

  10. To exercise their rights, the Customer may contact the Administrator by e-mail: kontakt@magbossauto.pl.

  11. The Customer has the right to lodge a complaint with the President of the Personal Data Protection Office if they believe their data is being processed unlawfully.


§ 7. Voluntariness of providing data

  1. Providing personal data is voluntary but necessary to place and fulfill an order, issue an invoice, deliver the Goods, handle complaints, process returns, or contact the Store.

  2. Failure to provide data necessary to fulfill the order may prevent the conclusion or performance of the contract.

  3. Providing data for marketing or analytical purposes, if such activities are conducted, is voluntary and depends on the Customer's consent.


§ 8. Contact form

  1. The store may provide a contact form allowing you to send an inquiry to the Seller.

  2. The data provided in the contact form is processed for the purpose of responding to the submitted inquiry and conducting further correspondence.

  3. Providing data in the form is voluntary, but necessary to receive a response.


§ 9. Newsletter

  1. At the time of drafting this Privacy Policy the Store does not operate a newsletter.

  2. If a newsletter is launched in the future, subscribing will be voluntary and will require providing an email address and giving consent.

  3. The customer may unsubscribe from the newsletter at any time.


§ 10. Electronic payments

  1. If electronic payment is selected, the data necessary to process the payment may be disclosed to the payment operator imoje.

  2. The payment operator processes data in accordance with its own terms and privacy policies.

  3. The administrator processes payment status information only to the extent necessary to fulfill the order.


§ 11. Order delivery

  1. To deliver the order, the Customer's data may be disclosed to courier companies and logistics operators.

  2. The data disclosed may include first and last name or company name, delivery address, phone number, email address, and shipment-related information.

  3. Data is disclosed only to the extent necessary to deliver the order.


§ 12. Profiling and automated decisions

  1. Customers' personal data are not used to make decisions that produce legal effects for the Customer or similarly significantly affect them in a fully automated manner.

  2. The Store may use analytical or advertising tools if the Customer has given the appropriate consents; however, these activities are intended to analyze site traffic, improve the Store's operation, or conduct marketing activities.


§ 13. Changes to the Privacy Policy

  1. The Administrator may change the Privacy Policy in the event of changes in legal provisions, changes to the Store's functionality, changes in the tools used, or changes in the way data is processed.

  2. The current version of the Privacy Policy is available on the Store's website.

  3. The Privacy Policy is effective as of: June 1, 2026.
